Is it a motor vehicle or not?
In a recent holding in New York, Justice Leonard Livote was faced with the issue of whether or not a golf cart was a motor vehicle. Despite the fact that the cart was not on a public highway, the Court held that the cart did indeed meet all the criteria for a motor vehicle. Accordingly, the plaintiff who had alleged that her injuries were the result of a golf cart flip, (driven by an employee of the Club), was allowed to proceed with the action. Guadagno v. Typically golf carts are not considered motor vehicles but you can be charged with driving under the influence when operating a golf cart.
